These terms and conditions govern your access to and use of the Pyro Group website (the "Site") and the submission of enquiries to Pyro Group, Work Plus Health, Medicals2U and Workfit Virtual Care (collectively, "Pyro Group", "we", "us" or "our"). By accessing or using the Site, you agree to these terms.
1. Use of the Site
You may use the Site for lawful purposes only. You must not use the Site in any way that breaches applicable laws, infringes the rights of others, or disrupts or interferes with its operation. We may modify or discontinue any part of the Site at any time without notice.
2. Enquiries and service requests
Submitting an enquiry through the Site does not constitute a contract or a guarantee of service. We will use reasonable efforts to respond to enquiries, but the provision of any service is subject to separate agreement, scheduling, availability and, where relevant, clinical suitability. Any occupational health or advisory services we provide will be subject to their own service terms.
3. Information you provide
You agree that any information you submit is accurate, current and lawfully provided. You confirm that you have the right to share any workforce or personal information you provide in an enquiry. How we handle personal information is set out in our Privacy Policy.
4. Intellectual property
All content on the Site - including text, graphics, logos, images and layout - is owned by or licensed to Pyro Group and protected by law. You may view and print content for personal, non-commercial use. You must not reproduce, republish, distribute or otherwise exploit the content without our prior written permission, except as permitted by law.
5. External links
The Site may contain links to third-party websites. We provide these links for convenience only and do not endorse, and are not responsible for, the content, accuracy or practices of those websites. Accessing third-party sites is at your own risk.
6. No warranties
The Site and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all warranties, representations and conditions relating to the Site. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.
7. Limitation of liability
To the maximum extent permitted by law, Pyro Group, its directors, employees, partners and affiliates are not liable for any loss or damage - direct, indirect, incidental, consequential or otherwise - arising from your use of, or inability to use, the Site or its content, including any reliance on information on the Site. Nothing in these terms excludes or limits any liability that cannot be excluded under applicable law.
8. General advice only
Content on the Site, including our blog, is general in nature and does not constitute medical, legal, financial or professional advice. You should obtain advice tailored to your circumstances before acting on any information provided. Clinical decisions are made by qualified practitioners in the context of individual assessments.
9. Payment terms
Unless otherwise agreed in writing, our standard payment terms are 14 days from the date of invoice. All fees for services are non-refundable once a service has been provided or an appointment, assessment or booking has been confirmed and commenced.
- Overdue invoices may be referred to an external debt collection agency. Any fees, costs or charges associated with debt collection are payable by the party owing the money and will be added to the outstanding invoice.
- Debt collection action may be triggered on invoices that remain unpaid 45 daysafter the due date.
- Interest at a rate of 10% per annum may be payable on any invoice amount that remains unpaid from 14 days after the due date until the invoice is paid in full.
10. Changes to these terms
We may update these terms from time to time. The updated version takes effect when published on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the updated terms.
11. Governing law
These terms are governed by the laws of Western Australia and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia.
